1. Acceptance of Terms

By accessing or using Validough ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

Validough is a course delivery platform that enables creators to validate course ideas and deliver digital courses to students. The Service includes:

Course validation tools (landing pages, waitlists)
Course delivery infrastructure
Student management features
Integration with payment platforms (Gumroad, Shopier)
Credit-based access system

3. Account Registration

To use certain features of the Service, you must create an account. You agree to:

Provide accurate and complete information
Maintain the security of your account credentials
Notify us immediately of any unauthorized access
Accept responsibility for all activities under your account

4. Credit System

Validough operates on a credit-based system:

New accounts receive 3 free credits
Each new student enrollment consumes 1 credit
An overdraft of up to 2 credits is allowed
When credits are depleted, new student access is paused until credits are purchased
Existing students maintain access regardless of credit balance
Credits are non-refundable and non-transferable

5. User Content

You retain ownership of content you upload to the Service ("User Content"). By uploading User Content, you grant Validough a worldwide, non-exclusive license to use, store, and display your content solely for providing the Service.

You agree not to upload content that:

Violates any applicable law or regulation
Infringes on intellectual property rights
Contains malware or harmful code
Is defamatory, obscene, or offensive
Violates the privacy of others

6. Acceptable Use

You agree not to:

Use the Service for any illegal purpose
Attempt to gain unauthorized access to our systems
Interfere with or disrupt the Service
Reverse engineer or decompile the Service
Use automated systems to access the Service without permission
Resell or redistribute the Service without authorization

7. Payment Terms

Payments for credits are processed through Paddle, our Merchant of Record. By making a purchase, you agree to Paddle's terms and conditions. All fees are exclusive of applicable taxes, which Paddle will collect as required.

8. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are owned by Validough Inc. and are protected by international copyright, trademark, and other intellectual property laws.

9. Termination

We may terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion.

Upon termination, your right to use the Service will cease immediately. You may export your data before termination.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VALIDOUGH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless Validough Inc. and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Validough Inc. is incorporated, without regard to its conflict of law provisions.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the new Terms.
